Sex offender accused of groping teen

Taunton - A 16-year-old girl has accused a convicted sex offender of groping her Tuesday in a local soup kitchen.

Raul Ruiz, 54, is being held on $25,000 cash bail on a charge of indecent assault and battery on a person 14 or older. He was arraigned Tuesday afternoon in Taunton District Court.

During lunch at the soup kitchen in the basement of St. Thomas Church, the teenage girl’s 20-year-old sister and friends sat at one table. Since there were no seats left, the 16-year-old sat at an adjacent table. She told police that Ruiz sat next to her, touched her between her legs and tried to get her to go to his apartment.

After the alleged groping incident, the 16-year-old abruptly left the soup kitchen and met up with her sister and friends, who had already finished eating and were waiting outside. After telling them that she had been groped, they went to the police station.

While speaking with an officer, the girl pointed out Ruiz’s picture on the bulletin board of registered sex offenders posted in the police station lobby, according to police reports.

Ruiz was required to register as a sex offender after being convicted in 1993 of indecent assault and battery on a child under 14 years of age, according to the state Sex Offender Registry Board’s Web site.

When questioned by police, Ruiz claimed “it was all a set up,” according to Patrolman Stephen Joiner’s incident report. Ruiz denied touching the girl or even sitting next to her, claiming that she had asked to use his cell phone.

Ruiz is due back in court May 5 for a pre-trial hearing.

SALEM, N.H. -- A Massachusetts registered sex offender was found guilty of loitering and interference with custody after he was found with a teenage boy in a Salem parking lot.

Rodney Martineau, 42, was found in a Main Street parking lot on Jan. 13 with a 15-year-old boy from Methuen, Mass., police said. The boy had snuck out of his home without his parents' knowledge, police said.

Investigators said they learned that Martineau was communicating with the boy on his computer and set up a meeting. The boy was taken into protective custody and released to his parents.

Martineau was eventually taken into custody and charged with loitering and interference with custody. He was found guilty Tuesday, and the case was referred to probation for a pre-sentence investigation.

Salem police said they forwarded the investigation to Methuen police because Martineau allegedly contacted the boy there.

NEW BEDFORD — A Level 3 sex offender was sentenced to 12 to 15 years in a state prison Wednesday, convicted of rape of a child with force and three counts of indecent assault and battery on a child under 14, according to Gregg Miliote, spokesman for Bristol County District Attorney C. Samuel Sutter.

Elias Acevedo, 38, of New Bedford was convicted by a jury of his peers in New Bedford Superior Court after a three-day trial.

Assistant District Attorney Maryclare Flynn had requested Judge Richard Moses to sentence Acevedo to life in prison due to the egregiousness of the facts involved, Miliote said.

Acevedo was convicted of sexually assaulting two girls who are now 11 and 13 years old. The sexual assaults occurred in New Bedford on diverse dates from 2004 to 2006. The girls made a disclosure in 2006, when Acevedo was arrested. He was arraigned in Superior Court on the charges in February 2008.

Upon release from prison, Acevedo will be on probation for 10 years. He must be monitored by GPS, have no contact with children, stay away from the victims and any witnesses, and undergo sex offender counseling, Miliote said.

Sex Offender Charged with Rape

NORTH ADAMS -- A level 3 sex offender is charged with raping a child in the North Adams Public Library last week.

James L. Coty, 56, of Rand Street in North Adams, allegedly threatened to stab a 15-year-old boy unless the boy let Coty perform oral sex on him in the library’s third-floor bathroom. If convicted, it would be a subsequent offense for Coty. Court documents state that he has a "long record of sex offenses."

According to police documents, Coty allegedly struck up a conversation with the victim in the early evening of March 16 in the library and then followed him outside. There, he threatened the victim and brought him to the bathroom where he forced the boy to let him perform oral sex on him. After the attack, Coty allegedly handed the victim a piece of paper with his name and phone number on it.

When the victim reported the attack to police, he described his attacker as "short, stocky, having a scruffy beard and having no top teeth." Police used the phone number to track Coty down through his sex offender registry information and then showed the victim Coty’s photograph. The victim identified him as his attacker.

Police located Coty on Union Street in North Adams and arrested him. Coty was charged with rape of a child by force, subsequent offense, last Tuesday in Northern Berkshire District Court. Bail was set at $40,000 cash or $400,000 bond due to the nature of the offense, the potential penalty

he faces and his record of convictions. Coty is being held in the Berkshire County House of Corrections and has been ordered to have no contact with the victim and no unsupervised contact with any person under 17-years-old. Should Coty post bail for release, he will be monitored by a Global Positioning System upon release.

Coty has a pre-trial hearing scheduled for April 13.

Last year, Coty pleaded guilty to two counts of enticing a child under the age of 16 and two counts of damage to a school building. He admitted making lewd comments to a then-14-year-old boy in North Adams on Sept. 27 and Sept. 29, 2006.

Accused Marblehead rapist gets bail reduced to $10G

SALEM - Bail for an 18-year-old Marblehead teenager charged with raping three eighth-grade girls was reduced Friday morning in Salem Superior Court to $10,000 cash.

Joshua Rodriguez, of 29 Bennett Road, Marblehead, petitioned the higher court for a reduction of the $15,000 cash ordered earlier in Lynn District Court.

Salem Superior Court Judge Paul A. Chernoff reduced that bail to $10,000, despite strong objections from Assistant District Attorney Meg Morrison that the cash bail amount set earlier in District Court stay the same, telling him the facts are "serious" and there are multiple victims.

The charges relate to the sexual abuse of three Marblehead teens who are 14 and 15 years old. The incidents were all reported in February, police said.

One of the 14-year-olds told authorities that Rodriguez came to a sleepover where she was last Dec. 23 and Rodriguez dragged her into a bedroom and raped her.

Another girl said she was raped Feb. 4 in a car parked on Round House Road.

The 15-year-old said she went to a movie during Christmas vacation with a group which included Rodriguez. After the movie they smoked marijuana and she passed out only to wake up and find Rodriguez inappropriately fondling her.

She told police about the sexual assault after the girl's mother reported her missing after leaving a suicide note that referred to Rodriguez.

Police located her in the organ loft of the Old North Church.

In her pitch for a reduction of the high bail amount, defense lawyer Sierra Rosen argued to Chernoff that the charges were issued "without investigation."

She questioned each incident, the date reported as well as the description of the vehicle in which one of the girls said she was raped.

Sierra pleaded for Chernoff to lower the bail to $5,000 on all three cases, but the judge declined.

In lowering the bail, Chernoff ordered that if Rodriguez makes bail he is to be placed on house arrest, monitored by an electronic bracelet and is to have no contact with any complaining witness or their family until the cases are resolved.

Rodriguez was taken back to the Middleton Jail. It is not known if he will make the bail.

Rodriguez is due back in Lynn District Court on April 28.
